If the Customer uses a Kuhlekt free trial, proof of concept version, beta version, or any other no-cost offering of Kuhlekt’s SaaS Products, including any related support services provided at Kuhlekt’s discretion (collectively referred to as “Trial Services”), Kuhlekt grants access under the following terms:

  1. Trial Duration: Trial Services are available until the earliest of:
    (i) the end of the trial, proof of concept, or beta testing period as communicated by Kuhlekt or specified in an order;
    (ii) the start date of any purchased subscription for the SaaS Products; or
    (iii) written notice of termination from Kuhlekt.
  2. Rights and Usage: During the trial period (“Trial Services Period”), the Customer receives a non-exclusive, non-transferable right to access and use the Trial Services solely for internal evaluation purposes, in accordance with the terms and conditions of Kuhlekt . Trial Services may not be used for business or productive purposes unless explicitly authorized by Kuhlekt in writing.
  3. Data and Configurations: Any data entered into the Trial Services and configurations made during the Trial Services Period may be permanently lost unless:
    (a) the Customer purchases a subscription to the SaaS Products covered by the Trial Services; or
    (b) exports the data or configurations before the trial ends.
  4. Features and Functionality: Features and functionality in the Trial Services may differ from those in the general release of the SaaS Products. Customers are encouraged to review the final product features before purchase.
  5. Support and Warranty: Kuhlekt provides Trial Services on an “as is” and “as available” basis, with no guarantee of support or service levels. To the extent permitted by law, Kuhlekt disclaims all implied warranties, including but not limited to, merchantability, fitness for a particular purpose, and non-infringement.
  6. Customer Assumption of Risk: The Customer assumes all risks and costs associated with using the Trial Services. The sole remedy for dissatisfaction or breach of this agreement concerning the Trial Services is termination of the trial.
  7. Services Unavailable during Trial Services: Access to 3rd party paid add-ons is not available in the Trial Services period, they are but not limited to tracked emails, SMS, Portals, Credit reporting and Onboarding services.
  8. Indemnity Exclusion: Kuhlekt has no obligation to indemnify, defend, or hold harmless Customers using Trial Services.

Free Trial Terms are read in conjunctioin with the Kuhlekt Schedule of Services. which on acceptance constitutes a contract.
